Report on Access to Domestic Genetic Resources
When researchers from Korea send domestic biological resources abroad and foreign nationals utilize them, the respective foreign researchers are required to submit a “Report on Access to Domestic Genetic Resources.”
- Korean citizens are free to use domestic biological resources for research purposes.
-
Reporting Compliance with Procedures to Access and Utilize Foreign Genetic Resources
When acquiring foreign biological resources for R&D purposes, it is necessary to obtain prior informed consent (PIC) from the country of origin of the biological material. Additionally, a Material Transfer Agreement (MTA) must be concluded with the biological provider to address the distribution (benefit-sharing) of research outcomes.
If you have received prior informed consent (PIC) from a country that is a party to the Nagoya Protocol, you must report this to the National Checkpoint in Korea (e.g. the Ministry of Science and ICT) within 90 days of the date of such receipt.
- If the country providing the resources is not a party to the Nagoya Protocol, there is no need to report it within Korea.
- Even if the country providing the resources is not a party to the Nagoya Protocol, compliance with ABS laws and procedures is required if they are in place. Additionally, it is essential to check for any other relevant laws and procedures that may exist.
